Terms of Service

These terms explain how Dalmatius subscription software may be accessed and used.

Dalmatius.com is operated from Europe. Legal notices, privacy requests, and support questions can be sent to legal@dalmatius.com. Business, tax, and invoicing details are provided where legally required or during checkout/invoicing.

Software access

Dalmatius provides web-based subscription software for business operations, including website analytics, Point of Sale (POS), customer and order management, and operational reporting. Your subscription gives you a limited, non-exclusive, non-transferable right to access the software during the active subscription period.

Accounts

You are responsible for keeping account credentials secure, controlling user access, and all activity under your account. You must provide accurate account, company, tax, and billing information and keep it up to date.

Acceptable use

You may not use Dalmatius to break the law, infringe third-party rights, process prohibited or unlawful activity, abuse the software, attempt unauthorized access, interfere with other users, or upload harmful content.

Customer content

You keep ownership of data and content you submit to Dalmatius. You grant Dalmatius the rights needed to host, process, transmit, display, back up, and secure that content only as needed to provide and improve the software, comply with law, and enforce these terms.

Intellectual property

Dalmatius owns or licenses all rights in the software, website, product design, source code, interfaces, documentation, trademarks, and related materials. Except for the limited subscription access described in these terms, no ownership or intellectual-property rights are transferred to you.

Subscriptions and billing

Paid Dalmatius products are sold as subscription software plans. Plan prices, billing periods, renewal terms, included features, usage limits, and any trial terms are shown before purchase or inside the billing flow. By starting a paid subscription, you authorize recurring charges until the subscription is cancelled.

Taxes and payment information

Prices may exclude taxes unless stated otherwise. Applicable taxes may be calculated and added during checkout. Payment and billing details may be collected and processed by payment, billing, tax, and fraud-prevention providers. Dalmatius does not store full card details.

Renewals, trials, and price changes

Subscriptions renew automatically for the billing period shown at checkout unless cancelled before renewal. If a free trial converts to a paid subscription, the first charge may occur when the trial ends. If a subscription price changes, we will give notice where required by law.

Cancellation

You may cancel a subscription through the available billing or account options, or by contacting support. Cancellation stops future renewals and access continues until the end of the current paid billing period unless stated otherwise. Cancellation does not automatically refund the current billing period.

Refunds

Refund eligibility is explained in the Refund Policy. If a refund is approved, access to the refunded subscription or product may end immediately.

Consumer withdrawal rights

If you are a consumer in the EU, EEA, UK, or another location with mandatory digital-content withdrawal rights, those rights apply as required by law. Where permitted by law, you may be asked during checkout to consent to immediate access to the digital software and acknowledge that withdrawal rights may be lost once access or use begins.

Data protection

The Privacy Policy explains how personal data is handled. Where GDPR applies and Dalmatius processes personal data on your behalf as a processor, the Data Processing Agreement applies and forms part of these terms.

Availability

We aim to keep Dalmatius reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, provider outages, internet failures, security issues, or technical problems may affect availability.

Suspension and termination

We may suspend or terminate access if these terms are violated, payment fails, use creates legal, security, fraud, or operational risk, or we are required to do so by law or a payment provider.

Termination effects

When a subscription ends, access to paid software features may stop. We may retain account data for a limited period to support export, billing, security, legal compliance, and dispute handling. After that period, data may be deleted or anonymized according to our retention practices unless law requires longer retention.

Warranty disclaimer

Dalmatius is provided on an as-is and as-available basis to the maximum extent permitted by law. We do not warrant that the software will meet every requirement, operate without interruption, be error-free, or be suitable for every business purpose.

Liability

To the maximum extent permitted by law, Dalmatius is not liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages arising from use of the software. Dalmatius' total direct liability for any claim is limited to the subscription fees paid for the affected product during the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot legally be limited or mandatory consumer rights that cannot legally be excluded.

Indemnity

If you use Dalmatius for unlawful activity, infringe third-party rights, submit unlawful content, misuse the software, or breach these terms, you agree to defend and indemnify Dalmatius from claims, losses, damages, liabilities, costs, and reasonable legal fees arising from that conduct to the extent permitted by law.

Changes to terms

We may update these terms from time to time. Material changes will be notified through the website, product, email, or another reasonable method. Updated terms apply from the effective date stated in the notice. If you do not agree to material changes, you should cancel your subscription before they take effect.

Governing law and disputes

These terms are governed by the laws applicable where Dalmatius.com is operated in Europe, without limiting mandatory consumer protections that apply in your country of residence. Courts in that place of operation have jurisdiction over business disputes, while consumers may have the right to bring claims in their country of residence where mandatory law allows.
